Should you be acting on behalf of a corporation or another legal framework, you declare that you possess the requisite authority to commit said organization to these Terms of Use, wherein “you” or “your” will refer to that organization. In the absence of such authority, or if you dissent with these Terms of Use, you are not permitted to access our website or Service.   1. OUR SERVICE

1.1 Our website, along with the Service made available to you via our website, is offered on an AS IS basis. You acknowledge that RemoteWork.ph holds the exclusive right to, at any moment and without notifying you or bearing any liability, alter or halt this website and its services or remove the data you submit, whether for a short duration or indefinitely. RemoteWork.ph bears no obligation or liability for the promptness, deletion, failure to preserve, inaccuracies, or improper delivery of any data or information. Furthermore, RemoteWork.ph maintains the right to manage the volume of sales for the service at its own discretion. RemoteWork.ph also has the authority to deny service to any person or corporation based on its sole judgment.

1.2 Unless specifically indicated otherwise, any additions, including new content and Services, will fall under these Terms of Use.

1.3 Should you find any modification to the Service unsatisfactory, terminating your subscription remains your sole option. Your ongoing utilization of the Service after we announce modifications to the terms or the website will signify your definitive agreement to such changes

 

  1. YOUR DUTIES AND SIGN-UP REQUIREMENTS

To acquire the Service, you are required to sign up on our website, commit to supplying accurate details upon request, be a minimum of eighteen (18) years of age or above, and adhere to the purchasing steps outlined in the “Order/Pricing” section and further detailed in Clause 5.   1. SERVICE ACCOUNT AND PASSWORD

4.1 The Service is provided to you through a Service Account following the payment specified in Clause 5.1.

4.2 Upon receiving your payment as set out in Clause 5.4, RemoteWork.ph will establish a Service Account under your name, granting you access to the Service in line with these Terms of Use.

4.3 Access to the Service Account is secured with a unique password, which will be issued to you upon payment confirmation and in adherence to these Terms of Use.

4.4 It is your responsibility to keep your password confidential and you will be accountable for all actions taken with your password, regardless of whether they were authorized by you. You are obliged to inform us promptly of any unauthorized use of your Service Account or password.

4.5 When accessing our website from a public computer, ensure you log out after completing your session.

4.6 You are allowed to create only one Service Account, and you must agree that the usage of your Service Account is solely for your personal use. Additionally, you consent that the Services provided through your Service Account will be utilized exclusively by you. NOTE: This clause also applies to Recruiting agencies. Utilizing our service to employ an individual for a DIFFERENT company, such as a client of your agency, is considered a violation of our terms. You are permitted to hire only for your OWN company, not on behalf of a client or any other third party.

4.7 Permitting others to use your Service Account and/or password constitutes a violation of these terms and conditions, and RemoteWork.ph reserves the right to terminate this Agreement pursuant to Clause 10.

4.8 The expected delivery time for your account should be within 10 minutes after placing the order. Nonetheless, this timeframe is approximate and may be subject to change due to extraordinary or unpredictable circumstances.

4.9 In the rare case that you do not gain access to your account within 30 minutes of placing your order, or if you have any grievances, please reach out to us via support@remotework.ph.

 

  1. PRICING AND PAYMENTS

5.1 The prices for services listed on the website at the moment and date of your transaction are applicable. We reserve the right to modify the cost of the Service prior to your subscription order. While we endeavor to ensure the prices on our website are correct, the price of your order will be confirmed by us during the order acceptance process. Should the price of a Service exceed what was quoted in your order, we will notify you, allowing you the option to cancel the order.

5.2 All prices are presented in US Dollars on the website.

5.3 The prices displayed include all applicable taxes.

5.4 Full payment must be received before we can confirm your order. A payment is considered made only when we have received the funds in full.

5.5 Payments must be made through credit or debit card at the moment of ordering through the website. We accept cards including Visa, MasterCard, American Express, and Discover.

5.6 Payment via mail or fax is not accepted.

5.7 You assure that the payment information you provide to us for the purchase of the Service is accurate. We hold the right to verify your credit or debit card details before supplying the Service.

5.8 We reserve the authority to decline any order you place.

  1. REFUNDS

RemoteWork.ph offers a full 30-day money-back guarantee. Only the most recent subscription payment is eligible for a refund (that is, the last payment made to RemoteWork.ph will be the only payment refunded), and no payments older than 30 days will be refunded. This refund policy is limited to one refund per customer.

  1. LICENSE GRANT & RESTRICTIONS

7.1 With your payment fully completed as detailed in Section 5, RemoteWork.ph grants you a non-exclusive, non-transferable, global right to utilize the Service, strictly for your own internal business use, following the terms and conditions of these Terms of Use. RemoteWork.ph reserves all rights not explicitly granted to you.

7.2 Access to the Service is forbidden if you are a direct competitor of RemoteWork.ph. Furthermore, the Service must not be accessed for the purpose of assessing its availability, performance, or functionality, nor for any benchmarking or competitive analysis. Soliciting or encouraging users to register or utilize another website is also prohibited.

7.3 You are not allowed to (i) license, sublicense, sell, resell, transfer, assign, distribute, or otherwise commercially offer or make the Service available to a third party; (ii) alter or create derivative works based on the Service; (iii) create Internet “links” to the Service or “frame” or “mirror” the Service on any other server, or wireless or internet-connected device; or (iv) reverse engineer or access the Service to (a) develop a competing product or service, (b) construct a product using similar ideas, features, functions, or graphics as the Service, or (c) copy any ideas, features, or graphics of the Service.

7.4 Use of the Service is limited to personal use, and you agree to do so without deploying automated methods, including but not limited to robots, unless explicitly authorized by RemoteWork.ph.

7.5 You must not: (i) transmit or store material infused with software viruses, worms, Trojan horses, or other harmful computer code, files, scripts, agents, or programs; (ii) disrupt or interfere with the integrity or performance of the Service or the data it contains; or (iii) seek unauthorized access to the Service or its related systems or networks.

7.6 RemoteWork.ph prohibits any individual or company from the adult/pornographic industry. We do not permit job postings or solicitations of workers for engagement in the adult industry, including tasks involving nude images/videos, adult-themed chat/text/writing, etc.

7.7 RemoteWork.ph forbids jobs that involve purchasing goods on behalf of the employer or managing/sending/receiving money transfers, including cryptocurrency (e.g., bitcoin).

7.8 RemoteWork.ph disallows jobs promoting gambling, drug use, hate speech, discrimination, defamation, violence, or any illegal activities.

7.9 RemoteWork.ph only permits job postings aimed at filling a vacant position. We do not allow postings solely for promoting a company/service/product, or for encouraging sign-ups for a networking company, competing service, or “become your own boss” schemes.

7.10 RemoteWork.ph does not permit unpaid trials or training periods. All hours worked during the interview process or training period must be compensated. Commission-only jobs are also not allowed. Positions must offer a base salary, although it is permissible to add commission on top of an appropriate base pay.

 

  1. INTELLECTUAL PROPERTY RIGHTS

Carson Moody Inc., along with its licensors where relevant, shall retain full ownership, including all intellectual property rights encompassing unpatented inventions, patent applications, patents, design rights, copyrights, trademarks, service marks, trade names, domain rights, expertise, and other trade secret rights, alongside all other intellectual property rights, derivatives thereof, and similar forms of protection globally, in connection with the RemoteWork.ph technology (this includes software, hardware, products, methodologies, algorithms, user interfaces, expertise, techniques, designs, and other tangible or intangible technical materials or information) and Service, as well as any suggestions, ideas, enhancement requests, feedback, or recommendations provided by you or any party regarding the Service. This Terms of Use agreement is not a transaction and does not grant you any ownership rights in or linked to the Service, RemoteWork.ph technology, or the intellectual property rights held by RemoteWork.ph. The RemoteWork.ph name, logo, and the product names associated with the Service are trademarks of Carson Moody Inc. or its third parties, and no rights or licenses are provided for their use.

  1. THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS

Third-party goods and services might be promoted and/or available on or through this website. While using the website, you might engage in communication, buy goods and/or services, or participate in promotions of third parties. Any such interactions, along with any terms, conditions, warranties, or representations linked with them, are strictly between you and the relevant third party. We bear no liability, obligation, or responsibility for any such interactions, purchases, or promotions between you and any third party. RemoteWork.ph does not endorse any internet sites linked through the Service. RemoteWork.ph provides these links for convenience only, and under no circumstances will RemoteWork.ph be accountable for any content, products, or other materials on or available from such sites.

 

  1. TERMINATION

10.1 You have the option to cancel your subscription for any Service purchased from us for any reason (this includes a change of mind) by directly canceling your subscription. This can be done by logging into your PayPal account, locating the “subscription creation” entry in your transaction history, clicking on it, and then selecting the “unsubscribe” option.

The individual subscriber is responsible for canceling their own recurring subscriptions. While cancellation requests can be sent via email, the inherent limitations of email communication mean that if you do not receive a confirmation of cancellation from us, you should not assume your subscription has been canceled!

10.2 Upon cancellation, you will retain access to the Service for the duration for which payment has been made.

10.3 Any failure to fulfill your payment commitments or unauthorized utilization of the Service or RemoteWork.ph will be considered a significant violation of these Terms of Use. RemoteWork.ph reserves the right to terminate your password, Service Account, or access to the Service if you infringe or fail to adhere to these Terms of Use.

10.4 We hold the authority to end this agreement or halt the Service or any part or feature thereof at any time and at our sole discretion.

10.5 Under the scenarios described in Clause 10.3, we will not issue a refund for any remaining term of the payment made.

10.6 After termination, you are required to eliminate all outputs of the Service from your possession or control, including any data on your website and servers.

10.7 Upon the termination of this agreement, all rights and duties of RemoteWork.ph and yourself under this agreement will cease.

10.8 If you allow others to use RemoteWork.ph through your account, we retain the right to pursue civil damages for any losses incurred due to such shared access. Only you are authorized to access RemoteWork.ph using your account.

 

  1. AFFILIATE PROGRAM

11.1 Payment: Affiliates earn a 40% commission for each new member subscription referred to our service. A referral is counted when a customer clicks on an affiliate referral link and completes the registration process. Affiliate payments are processed 30 days following the month in which a sale occurred, typically between the 1st and 5th of the subsequent month. Please anticipate additional time for holiday periods. For instance, commissions for sales in January are paid at the start of March. Affiliates need to accumulate at least $50 in commissions before a payment is disbursed. All payments are made via PayPal, and affiliates are responsible for ensuring they can receive payments from the US through PayPal. Affiliates bear the responsibility for any fees, taxes, exchange rates, surcharges, and other expenses incurred in receiving their commissions.

11.2 Reversals: Commissions will be deducted for referrals that are refunded. Referrals found to be fraudulent (using false information, fake/stolen credit cards, etc.) will be reversed. Chargebacks on credit cards for referrals will result in commission reversals. Commissions will not be paid for referrals that are for your own subscription or for signing up business partners, spouses, etc. Using your own affiliate link for sign-ups is prohibited. RemoteWork.ph reserves the right to withhold commissions based on suspicions of account signup fraud.

11.3 Advertising Compliance: Affiliates are prohibited from offering cash back, rewards, or other incentives. Bidding on trademark keywords for PPC advertising on search engines (Google, Yahoo, MSN, Ask) is not allowed, and affiliates found violating this rule will be deactivated. Trademarked terms include “RemoteWork”, and any use of these terms in PPC is forbidden. Affiliates may utilize approved banners and ad text from the affiliate management center, ensuring their tracking code functions correctly before directing traffic to our servers. Affiliates are solely responsible for any modifications to the links; tracking errors resulting from edits, masking, or tampering with links will lead to non-payment of commissions. Affiliates must not engage in any deceptive practices to generate transactions that are not initiated by an end user’s affirmative action. Using cookies, devices, programs, robots, iframes, hidden frames, pop-up windows, or any other methods that interfere with proper transaction tracking is prohibited. Affiliates are advised against using framesets and iframes due to these restrictions. Affiliates must not deliver tracking tags to end users’ computers by merely viewing a website, promotional content, or advertisements, or while applications are merely active or open. Interfering with or improperly influencing the referral of an end user to participating sites and content without explicit consent through affirmative action by the end user is forbidden. Affiliates must not falsely represent or imply that a visitor to their website and/or promotional content is visiting participating sites and content. Affiliates are prohibited from intercepting or redirecting traffic or diverting compensation from participating sites and content or any other affiliate. Links or promotional content must not be placed in inappropriate forums such as third-party newsgroups, message boards, blogs, comments, link farms, classified ad services, counters, chatrooms, or guestbooks unless permitted by their terms and conditions. Links or promotional content must avoid topics that RemoteWork.ph deems inappropriate, including sexually explicit materials, violence, weapons, illegal activities, gambling, discrimination, libel, content aimed at children, misleading, obscene, or hate-oriented content. Affiliates must also avoid misleading activities like typo-squatting, domain-parking, banner-farming, and comment-spamming. Links or promotional content must not appear on websites that engage in search engine manipulation, unlawful use of meta-tags, or any activities RemoteWork.ph considers inappropriate. Restrictions apply to serving pop-ups or pop-unders in connection with other such advertisements, ensuring browser back buttons are functional, and avoiding software downloads without express consent from the end user. If program terms allow links in paid search results, affiliates must not purchase or register search engine keywords, AdWords, search terms, or other identifying terms that RemoteWork.ph deems inappropriate for promoting objectionable materials or infringing upon others’ rights. Email promotions require advance written approval from RemoteWork.ph or the advertiser, and RemoteWork.ph reserves the right to terminate any email promotions at any time.

11.4 Deactivation: Affiliate accounts can be deactivated at any time without warning. Accounts will be deactivated and commissions reset to $0 for non-compliance with affiliate terms. False advertising or suspected fraudulent activity associated with an affiliate account will result in immediate deactivation. Accounts generating numerous fraudulent accounts are subject to deactivation upon review.

 

  1. INDEMNITY

You commit to indemnify and absolve us, our subsidiaries, affiliates, associates, officers, directors, employees, agents, independent contractors, advertisers, partners, and co-branders from any claim or demand, including reasonable legal fees, that might be filed by any third party, due to or arising from your actions or association with this website or Service, your breach of these Terms of Use, or any other infringement of the rights of another individual or entity.
